1. Recruitment Records and Transparency
• We will maintain up-to-date records of all seafarers recruited or placed through our agency. These records will be available for inspection by the relevant authorities upon request.
• We will ensure that our management and staff receive regular training and possess the necessary knowledge of the maritime industry pertinent to their roles.
2. Seafarer Rights and Employment Agreements
• Seafarers will be informed of their rights and duties under their employment agreements before or during the recruitment process. Proper arrangements will be made for seafarers to review their employment agreements before and after signing. Copies of these agreements will be provided to the seafarers.
• We will verify that all recruited seafarers are qualified and hold the necessary documents for their positions. Employment agreements will comply with applicable flag State laws, regulations, and any collective bargaining agreements.
3. Seafarer Protection and Welfare
• We will ensure that ship owners have means to protect seafarers from being stranded in a port. In such cases, we will make provisions for repatriation, including maintenance, emergency medical assistance, and transportation of mortal remains if necessary.
• Any complaints regarding our recruitment activities will be promptly examined and addressed. Unresolved complaints will be reported to the Director-General.
• We will ensure that no mechanisms or lists are used to prevent seafarers from obtaining employment for which they are qualified. Seafarers will not bear any fees other than those for personal documents (e.g., medical certificates, seafarer’s book, passport). Costs for visa, pre-sign-on, and post-sign-off medical examinations will be covered by the ship owner. Records of any charges collected from seafarers will be maintained.
4. Incident Reporting and Documentation
• Any incident causing injury (excluding minor injuries), death, disappearance, or homicide involving an Indian National onboard will be reported to the Director-General within twenty-four hours of receiving the information.
• We will verify seafarers' medical examinations, identity documents, and other required items to ensure they meet employment standards.
• We will maintain up-to-date lists of ships served by our recruitment policy and ensure they can be contacted in emergencies at all hours.
5. Seafarer Exploitation and Financial Transactions
• We will implement procedures to prevent exploitation of seafarers concerning engagement offers or financial transactions. Joining advances or similar financial transactions will be handled in a manner that prevents exploitation.
• Seafarers will be informed of any specific job conditions and ship-owner policies related to their employment.
• Procedures for addressing incompetence or indiscipline will align with principles of natural justice, applicable laws, and collective bargaining agreements.
